1. About these Terms
These Terms and
Conditions (the “Terms”) govern your access to and use of divehalo.com and any
related
Dive Products online store, checkout, customer account, order,
product, content, or service (collectively, the “Website”).
The Website is
operated by STEALTH DIVE SYSTEMS - FZCO, a company incorporated in Dubai,
United Arab Emirates (“Stealth,” “we,” “us,” or “our”).
Dive Products
(“
”) is a trading brand of Stealth and is not a separate legal entity.
By using the Website, creating an account, submitting an order, or purchasing a product, you agree to these Terms and to any policies referenced in them, including our Privacy Policy, Shipping Policy, Returns and Refund Policy, and Warranty Policy. If you do not agree, do not use the Website or place an order.

3. Eligibility and Customer Accounts
You must have legal capacity to enter into a purchase contract. If you are under the age of legal majority where you live, a parent or legal guardian must place or approve the order on your behalf.
You are responsible for providing complete and accurate account, billing, shipping, and contact information and for maintaining the confidentiality of your login credentials. You must promptly notify us of any suspected unauthorized use of your account.
We may refuse, suspend, or close an account where reasonably necessary to prevent fraud, misuse, security risks, legal violations, or harm to us, our customers, or third parties.
4. Products and Product Information
We sell scuba-diving equipment, accessories, bags, masks, snorkels, fins, boots, and related products. Product availability, specifications, colours, materials, packaging, photographs, and descriptions may change without notice, provided that any change does not materially reduce the product you agreed to purchase.
We take reasonable care to display product colours and images accurately, but screens and lighting can cause differences. Minor colour, texture, logo-placement, packaging, or manufacturing variations that do not affect the product’s intended function are not defects.
Measurements and size charts are guides only. You are responsible for reviewing the applicable product information and selecting an appropriate size or variant before ordering.
5. Diving Safety and Proper Use
Scuba diving and water activities involve inherent risks. HALO products must be selected, fitted, inspected, maintained, stored, and used correctly and only for their intended purpose.
Obtain appropriate training, certification, supervision, and experience for the activity you undertake.
Read and follow all product instructions, warnings, care information, and applicable industry guidance.
Inspect each product before every use. Do not use a damaged, altered, excessively worn, poorly fitting, or malfunctioning product.
Rinse, dry, maintain, and store products as directed.
Do not rely on Website content as a substitute for professional dive instruction, equipment servicing, medical advice, or emergency planning.
Nothing in these Terms excludes or limits any responsibility that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence where applicable law prohibits such an exclusion.
6. Prices, Currencies, Taxes, and Import Charges
Prices are shown in the currency displayed at checkout. We may change prices at any time before an order is accepted. A price change will not affect an order that we have already accepted, except where the displayed price resulted from an obvious error that a reasonable customer would recognize.
The checkout will state whether taxes are included, added, or not collected. Unless the checkout expressly states otherwise, international customers are responsible for customs duties, import taxes, brokerage charges, local fees, and other amounts imposed by the destination country.
Currency conversion charges or foreign transaction fees imposed by your card issuer, bank, or payment provider are your responsibility.
7. Orders and Contract Formation
Submitting an order is an offer to buy the selected products. An automated order acknowledgement confirms receipt only; it does not necessarily mean that we have accepted the order.
A binding sales contract is formed when we send an order acceptance or dispatch confirmation, or when we otherwise begin fulfilling the order, whichever occurs first. Each accepted order is a separate contract between you and STEALTH DIVE SYSTEMS - FZCO.
We may reject or cancel an order before acceptance for reasons including unavailable stock, pricing or description errors, suspected fraud, payment failure, shipping restrictions, sanctions or export-control concerns, unusually large quantities, or inability to verify customer information.
If we cancel an order after payment has been authorized or collected, we will arrange a refund to the original payment method, subject to normal payment-processing times.
8. Payment
Payment must be made using an approved method displayed at checkout. Payments may be processed by third-party payment providers. Their separate terms, privacy notices, verification procedures, and processing rules may apply.
You confirm that you are authorized to use the selected payment method and that the payment information you provide is accurate. We may use reasonable fraud-prevention and identity-verification measures before accepting or dispatching an order.
We do not guarantee that a particular payment method will always be available. We may add, remove, suspend, or replace payment providers without changing these Terms.
9. Shipping and Delivery
Shipping destinations, methods, estimated processing times, delivery estimates, tracking arrangements, and shipping charges are described at checkout and in our Shipping Policy.
Delivery dates are estimates unless we expressly agree to a guaranteed date in writing. Customs inspections, carrier disruption, severe weather, public emergencies, incorrect addresses, remote-area delivery, and events outside our reasonable control can cause delays.
You are responsible for providing a complete, accurate, and deliverable address and for monitoring tracking information. Additional costs caused by an incorrect or incomplete address, refusal of delivery, failure to collect a shipment, or unauthorized rerouting may be charged to you where permitted by law.
10. Risk of Loss and Ownership
Risk of loss or damage passes as required by the mandatory law applicable to the transaction. Where no mandatory rule applies, risk passes when the product is delivered to you or to a person you nominate at the delivery address.
Ownership of the products passes only after we receive full payment of all amounts due for the order, unless applicable law requires otherwise.
11. Cancellations, Returns, and Refunds
Your cancellation, return, exchange, and refund rights are governed by our Returns and Refund Policy and by any mandatory consumer law that applies to your purchase.
Unless required by law or stated otherwise in our Returns and Refund Policy, returned items must be unused, clean, complete, unaltered, in resalable condition, and accompanied by the original packaging, labels, accessories, and proof of purchase.
For hygiene, safety, or product-integrity reasons, certain opened, used, personalized, clearance, or final-sale items may be excluded from voluntary returns where permitted by law. This does not remove rights relating to defective, unsafe, misdescribed, or incorrectly supplied products.
Approved refunds are normally issued to the original payment method. Banks and payment providers control the time required for the refund to appear.
12. Damaged, Defective, or Incorrect Products
Inspect your shipment promptly after delivery. If an item arrives damaged, defective, incomplete, or different from what you ordered, contact support@divehalo.com as soon as reasonably possible and provide your order number, a description of the issue, and clear photographs or video where appropriate.
We may request reasonable evidence and may require the product to be returned for inspection. Depending on the circumstances and applicable law, the available remedy may include repair, replacement, refund, or another appropriate solution.
Normal wear, accidental damage, misuse, improper fitting, incorrect storage, unauthorized alteration, poor maintenance, cosmetic variation, or damage caused by use contrary to instructions is not a manufacturing defect.
13. Product Warranty
Any
Dive Products commercial warranty is described in the Warranty Policy or accompanying product
materials. A commercial warranty is in addition to, and does not replace,
mandatory consumer rights that apply to defective or non-conforming goods.
Warranty claims may require proof of purchase, product identification, photographs, the lot or serial number where applicable, and a description of the issue and use history.
14. Promotions, Discount Codes, and Bundles
Promotions, discount codes, bundles, gifts, and special offers are subject to their stated conditions, validity period, eligibility restrictions, product availability, and any minimum spend. Unless expressly stated, promotions cannot be combined, exchanged for cash, transferred, or applied retroactively.
If a bundle or promotional order is returned, the refund may be recalculated to reflect the value of retained items, provided that this is explained in the applicable offer or Returns and Refund Policy and is permitted by law.
15. Intellectual Property
The Website and its text, photographs, graphics, logos, product names, designs, layouts, videos, software, and other content are owned by or licensed to us and are protected by intellectual-property laws.
You may use the Website for personal, non-commercial shopping and information. You may not copy, reproduce, republish, distribute, modify, scrape, frame, reverse engineer, sell, exploit, or use our content or trademarks without prior written permission, except where applicable law expressly allows it.
16. Reviews, Messages, and User Content
If you submit a review, photograph, message, testimonial, or other content, you confirm that it is truthful, based on your own experience, lawful, and does not infringe another person’s rights.
You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, adapt, and use that content for operating, improving, and promoting HALO, subject to applicable privacy law. We may remove content that is unlawful, misleading, abusive, irrelevant, infringing, or otherwise inappropriate.
17. Prohibited Uses
You must not use the Website to:
break any law, regulation, sanctions rule, export-control requirement, or third-party right;
commit fraud, submit false information, misuse payment methods, or evade security controls;
introduce malware, interfere with the Website, overload systems, scrape data without permission, or attempt unauthorized access;
impersonate another person or use the Website in a threatening, abusive, defamatory, or deceptive manner; or
resell products in violation of an applicable reseller, distributor, territorial, or brand agreement.
18. Third-Party Services and Links
The Website may use or link to third-party services such as payment processors, carriers, analytics providers, mapping services, social-media platforms, and marketplaces. We are not responsible for a third party’s independent website, content, availability, or practices, although this does not limit any responsibility we have under applicable law for providers acting on our behalf.
19. Privacy and Cookies
Our collection and use of personal information is described in our Privacy Policy and Cookie Policy or cookie notice. Those documents form part of the Website rules and should be read together with these Terms.
20. Website Availability and Errors
We aim to keep the Website available and accurate, but we do not guarantee uninterrupted, error-free, or completely secure access. We may suspend access for maintenance, updates, security, legal compliance, or events outside our reasonable control.
We may correct typographical, technical, pricing, availability, or product-information errors. If a correction materially affects an order you have already submitted, we will notify you and provide any remedy required by applicable law.
21. Limitation of Liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, or any mandatory consumer remedy.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, exemplary, or consequential losses, or for loss of profit, revenue, opportunity, data, goodwill, or anticipated savings, arising from use of the Website or products, except where such loss results from our fraud, wilful misconduct, gross negligence, breach of mandatory law, or another basis that cannot lawfully be excluded.
Where liability may lawfully be limited, our total liability arising from a particular order will not exceed the amount paid for that order. This limitation does not apply where prohibited by applicable law.
22. Events Outside Our Reasonable Control
We are not responsible for delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, epidemic or pandemic conditions, war, civil disturbance, government action, sanctions, port or customs disruption, carrier failure, labour disputes, telecommunications outages, cyber incidents, or interruption of essential utilities. We will take reasonable steps to reduce the effect of such events and will provide any remedy required by law.
23. Changes to these Terms
We may update these Terms to reflect changes in law, our business, products, payment methods, security, or Website functionality. The current version and effective date will be posted on the Website. Changes will apply prospectively and will not reduce rights already attached to an accepted order unless the law permits and you agree.
24. Governing Law and Disputes
These Terms and any non-contractual obligations arising from them are governed by the laws of the United Arab Emirates and the applicable laws of the Emirate of Dubai, without prejudice to mandatory consumer protections that apply in the country where you live.
Please contact support@divehalo.com first so that we can attempt to resolve any concern promptly. If a dispute cannot be resolved informally, the courts of Dubai, United Arab Emirates will have jurisdiction, except where mandatory consumer law gives you the right to bring a claim in another forum.
25. General Provisions
If any provision of these Terms is held invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect.
Our failure to enforce a provision immediately is not a waiver. You may not assign your rights or obligations under an order without our written consent. We may assign our rights and obligations as part of a genuine business transfer, restructuring, or sale, provided that your mandatory rights are not reduced.
These Terms, together with the order details and the policies expressly incorporated by reference, form the agreement relating to your use of the Website and purchase of products.
